Inequality in posting: Teachers stuck in schools, unable to make adjustments

UP Shikshak Samayojan 2024: Despite repeated orders, teachers are not being adjusted in government and aided secondary schools. The Secondary Education Department, which failed to make adjustments even in six years in 2363 government schools and in 4512 aided colleges in one and a quarter years, has once again started the process. Director of Secondary Education Dr. Mahendra Dev has ordered adjustment of surplus teachers in aided colleges on 22 December 2023 and in government schools on 10 January 2024.

The officials of the department want to adjust the surplus teachers in government schools on the basis of student population, while the teachers' organizations are against the removal of teachers working on the created posts. Due to this dispute, adjustment has not been possible since 2018. This time the Director has constituted a committee for adjustment under the chairmanship of the Divisional Joint Director of Education. Divisional Deputy Education Director and District School Inspector will be members of the committee. The committee has to give information about surplus teachers at the divisional level by e-mail by January 20.

Employer Manager, how will the transfer happen?
The Director has ordered for adjustment of surplus teachers in aided colleges on 22 December 2023, but there is a hurdle in it. There is no provision for adjustment in the Intermediate Education Act 1921. In aided colleges, the institution itself is the unit of selection and the manager is the employer. Seniority is determined from the date of selection. In such a situation, the possibility of dispute regarding seniority due to adjustment cannot be ruled out, because this will reduce the previous years of experience of the teacher being adjusted to zero. The adjusted teacher will be the most junior in the new school. Due to zero service years, the teacher will suffer financial loss. If the seniority of the adjusted teacher is maintained, then the teachers already working in that school can take the help of court to maintain their seniority.
