Meanwhile, the Supreme Court has requested from all the parties what constitutional issues are involved in the power struggle of Maharashtra and on the basis of this, the court is likely to decide whether to hand over the matter to a five-judge constitution bench or not, according to senior legal expert Jugalkishore Gilda. < br /> 
Though there seems to be no argument about the authority of the Governor, there are many old decisions of the Court which have held that the Court cannot interfere with the actions of the Governor. Therefore, Gilda said that even if the case of Maharashtra’s power struggle goes to the Constitutional Court, there is no clarity on whether the issue of the Governor’s authority can go to the Constitutional Court or not.

Maharashtra has a total of six petitions before the Supreme Court regarding the power struggle. No one has yet opposed the consolidation of all the six petitions before the Constitution Bench. Gilda said that the possibility that all the six petitions will be handed over to the Constitution Bench together cannot be ruled out.
