Shock to Bhopal Gas Tragedy victims, Court refuses to direct additional compensation, SC dismisses Centre’s plea

Bhopal: The Supreme Court refused to give directions for additional compensation in the Bhopal gas tragedy. The Supreme Court rejected the curative petition of the Central Government in which the Center had sought direction for additional compensation in the Bhopal gas tragedy. In the Bhopal gas tragedy of 1985, the central government had requested to give instructions to give additional compensation of 7844 crores. A five-judge constitutional bench of the Supreme Court said that after two decades of settlement in the matter, there is no justification left for the Center to take up the matter. The Supreme Court has said that Rs 50 crore of the compensation amount, which is kept with the RBI, can be used by the Central Government to settle the pending claims of the Victim.

A bench headed by Supreme Court Justice SK Kaul said that the curative petition cannot be accepted and dismissed the application. After hearing the curative petition of the central government to give additional compensation to the victims in the Bhopal gas tragedy, the Supreme Court had reserved the decision on January 12, in this case, the central government had filed a curative petition against Union Carbite Corporation in 2010 for additional compensation. Compensation was demanded.

The successor firm of Union Carbite Company said that if the rupee depreciates, it cannot be a ground to enhance the compensation amount. It was argued on behalf of the successor company that in 1989 there was a settlement between the company and the Central Government for the compensation amount. Thereafter there was a fall in the value of rupee and this cannot be the basis for enhancement of the compensation amount. The Central Government had filed a curative petition demanding an additional amount of Rs 7844 crore as compensation from the Union Carbite Company.

In the Bhopal gas tragedy, 3,000 people had died and the environment had suffered huge damage. On October 31, 2022, the Attorney General, on behalf of the Central Government, said in the Supreme Court that it is in favor of continuing the curative petition filed for seeking additional compensation to the Victim in the Bhopal gas tragedy. The Constitutional Bench of the Supreme Court had asked the Central Government to clear its stand on the petition in which the petitioner has demanded additional compensation to the victims of the Bhopal gas tragedy.
