Uddhav Thackeray ready for Dussehra rally, SC’s plan to make Eknath Shinde camp; Rar continues on Shivaji Park

Shiv Sena chief Uddhav Thackeray-led faction has got permission to hold a Dussehra rally at Shivaji Park. Now there is news that Chief Minister Eknath Shinde Camp can approach the Supreme Court regarding this. On Friday, the High Court reprimanded the Brihanmumbai Municipal Corporation for “misuse of power”. Shiv Sena has been organizing a rally at Shivaji Park for more than 5 decades.

According to media reports, Shinde Camp may approach the Supreme Court against the High Court’s decision. In the High Court also, application was made against the petition of Thackeray camp on behalf of Mahim MLA Sada Sarvankar. However, the court rejected the application of the Shinde Camp MLA.

Justice Ramesh D Dhanuka and Justice Kamal R Khata have ordered the petitioner to use the ground for preparations and rally related works between October 2-6 to the BMC. Also, the court has directed the police to make adequate security arrangements on the spot. The court has also asked for video recording to avoid any violation on the part of the petitioners.

Shiv Sena has been organizing Dussehra rally at Shivaji Park (Shiv-teerth) for years but this year after Chief Minister Eknath Shinde-led faction of Shiv Sena also sought permission to organize rally at the same ground on Dussehra day (October 5). It was embroiled in legal disputes.

The Thackeray-led Shiv Sena faction and its secretary Anil Desai had challenged the BMC’s order. The bench said, “In our view, the BMC has not taken the decision with a clear mind. The petitioner has been getting permission to hold Dussehra rally at Shivaji Park in the past. In its order, the court said, “BMC not allowing the rally merely on the ground of the existence of another applicant is a clear abuse of the process of law.” The court said the civic body had “abused its powers on a very mild ground”.

The BMC had on September 21 said that it was rejecting the Thackeray-led party’s application as MLA Sada Saravankar, a rebel faction of Maharashtra Chief Minister Eknath Shinde-led Shiv Sena, has made a similar application and if permission is granted to one faction. So this will create law and order problem for the local police. The BMC also submitted to the court a report raising concerns regarding the rally by Shivaji Park police station.
