A man reached the High Court seeking custody of his girlfriend’s girl from her husband. When this matter reached the court, the judge was also surprised by the young man’s demand and dismissed the case by imposing a fine of Rs 5000 on him for filing the application. The man said that he was in a live-in relationship with his girlfriend and there was an agreement between the two. This matter is of Gujarat Banaskantha district. The man filed an application in the High Court saying that he was once in a relationship with the woman whose custody he was seeking.

The man, who was the lover of the woman, claimed that she was married without her consent. She does not get along with her husband even today. The woman had also come to live with him leaving her husband. During this, both had also entered into a live-in relationship agreement. The young man said in his application that we were living in the live-in. Then the girl’s in-laws came and forcibly took her with them. He said that my girlfriend has been forcibly kept by her in-laws and she does not want to stay with them. The Gujarat government opposed the young man’s application and said that he has no right to seek custody of the woman.

The counsel for the state government said that the woman is living with her husband. It cannot be said that he has been kept illegally. After hearing the case, a bench of Justice VM Pancholi and Justice HM Prachak said that the person who filed the application was not married to the woman. Apart from this, she has not even divorced her husband. In such a situation, the person cannot talk about living with the woman, nor does the question of custody arise. Not only this, the court also imposed a fine of Rs 5000 on the petitioner.
