The Punjab-Haryana High Court, while dismissing the petition challenging the order of payment of alimony, made it clear that the alimony cannot be denied by arguing that the wife is educated. While filing the petition, the husband resident of Ambala told the High Court that he was married in 2016. After some time, the petitioner’s wife left him without any reason. After this he applied for alimony in the family court of Ambala.

The Family Court of Ambala, while giving a verdict in favor of the wife, ordered her to pay alimony of Rs 3600 per month. The petitioner said that he works as an assistant in a drugstore and gets Rs.4000 per month. The petitioner submitted that his wife has done MA in Hindi and her father works as a lawyer’s clerk. The petitioner said that the order for grant of maintenance is not correct and it should be quashed.

Dismissing the petition, the High Court said that it is the legal and moral responsibility of the petitioner to take care of his wife and children. By arguing that the petitioner’s wife is educated, the alimony cannot be denied.
