Rahul Gandhi, MP from Kerala’s Wayanad Lok Sabha seat, was yesterday sentenced to two years in jail by the Surat sessions court in a defamation case. After this, today he may get another big shock. According to Section 8 of the Representation of the People Act, membership of an MP or MLA is lost if the punishment is two years or more. Now the sword of this law hangs over Rahul Gandhi as well and a decision can be taken today in this regard from the Lok Sabha Secretariat. Rahul Gandhi had made objectionable remarks about the Modi surname during the campaign before the 2019 Lok Sabha elections.
Didn’t change even after advice, court told why Rahul was given strict punishment
A Lok Sabha official told Hindustan Times, “Background work has started to decide on Rahul Gandhi’s membership. It will take only 10 minutes to prepare the file and take the advice of the Lok Sabha table office on it. In this, the same process will be adopted, which was done regarding Lakshadweep MP Mohammad Faizal. If a decision is taken in this regard today itself, then the Speaker of the Lok Sabha can announce it in the House on Friday itself.
How can Rahul Gandhi’s membership be saved, this is the way
If Rahul Gandhi wants to save his Lok Sabha membership, he will have to go to the High Court and appeal against the sentence. If his sentence is reduced or it is suspended, then his membership will be saved. Party leader and legal expert Abhishek Manu Singhvi said that by the end of this week, we will file an appeal in the sessions court.
Rahul Gandhi has got a chance to appeal for 30 days.
Rahul Gandhi has been convicted under sections 499 and 500 of the IPC. He was given a two-year sentence on Thursday and then released on bail. At present, the court has given Rahul Gandhi 30 days to appeal and till then the sentence has been suspended.
