PFI, who was accused in many crimes, has now been banned for 5 years. Earlier, action was taken by the NIA on the bases of PFI and many people were also arrested. Now the central government has declared the Popular Front of India (PFI) an “unlawful association” under the Unlawful Activities Prevention Act (UAPA), 1967.

After the ban of PFI, now a lot of changes are possible in the organization and many restrictions will be imposed on this organization and its members. Will anything change?

1. As reported by The Indian Express, now central law enforcement agencies and state police across the country have been empowered to arrest the members of the organization, freeze its accounts and even confiscate their assets.

2. After the ban under UAPA, according to Section 10 of the UAPA, taking membership of a banned organization comes under the category of crime. Anyone who becomes a member of a banned organization can be punished with imprisonment of up to two years and in some circumstances it can be extended to life imprisonment and even death.

3. In terms of section 10, any person who continues to be a member of such organization or takes part in the meetings of such organization or if he associates with this organization, takes any co-operation or assists in the operation of such organization, then two Year in prison or fine can be imposed. This section also applies to those people who help the banned organizations for any purpose.

Explain that through these rules, hundreds of members of the Students Islamic Movement of India (SIMI) were arrested by the central agencies and the state police. The ban on SIMI was imposed by the Atal Bihari Vajpayee government. These provisions were used to arrest many people in LWE affected districts as well. That is, many people have already been arrested under these sections.

Will the investigating agency get the rights?

At the same time, after the ban is imposed, Section 7 of the UAPA also gives many powers to the government to stop the use of funds. With this, if someone is taken into custody after this ban, then the investigating agency can investigate his funds etc. That is, he can check on the transaction of his money. At the same time, it also gives the power to the investigating agencies and the police to conduct raids and searches on the premises of such organizations and to check their books of accounts.
