Srinagar: High Court said – not all women can claim 180 days maternity leave

The Jammu and Kashmir and Ladakh High Court has given an important decision on a petition related to the provision of 180 days maternity leave for women. Justice Mohd Akram Chowdhury said during the hearing that SRO 353 has a provision of 180 days maternity leave, but not every woman can claim it as a right. It is also necessary to see what duty the female employee is doing.

He said that the leave of doctors and other staff has been canceled in the Corona epidemic. In such a situation, before granting 180 days maternity leave to a doctor, the concerned authority will have to ensure that the work is not affected. Therefore, the court dismisses the petition seeking to order a leave of 180 days. However, the order states that the 45-day leave sanctioned may be extended for such time as may be necessary in view of the circumstances.
