Haryana Crime: Court acquits rape accused, says – 36-year-old woman alone cannot do this

Fatehabad Rape Case: A court in Haryana’s Fatehabad has acquitted the rape accused with the benefit of doubt. The court found that there was a delay of about two and a half months in registering the FIR. The fast track special court of Additional District and Sessions Judge Balwant Singh said that the prosecution has failed to prove the case against the accused beyond reasonable doubt. The orders said, "Giving the benefit of doubt, the accused is acquitted of the charges against him."

It may be mentioned that the victim had claimed in her complaint that Balwinder had raped her on 5 and 6 April 2021. According to the victim, at the time of the incident, her husband had gone out of the village and her children were sleeping. In the complaint, the woman said that Balwinder caught her and took her to a room before raping her. Along with this, it was also alleged that Balwinder had threatened to kill him if he told anyone about the incident. A case was registered against Balwinder in Tohana City Police Station in June 2021.

The accused was granted anticipatory bail by the Punjab and Haryana High Court

Police registered a case against Balwinder under Section 376 (2), 450 and 506 of the IPC. In this case, the accused got anticipatory bail from the Punjab and Haryana High Court. While hearing the case, the court said that it is a fabricated story only to implicate the accused. Also, the court said that if this had happened, why was there a delay of two and a half months in filing the complaint? Being a strong woman, it is not possible that the accused forced the victim by covering her mouth with one hand. She is a fit (physically fit) woman, aged around 36 years.
