After the Special Leave Petition (SLP) filed earlier by the state government and now the review (review) petition was dismissed in the Supreme Court, the way has been cleared for the unemployed to get stipend (allowance) despite training in the specific BTC 2004 batch. With this order, it has been decided that about 500 unemployed will get arrears of honorarium of Rs 2.75-2.75 lakh.
For the training of the special BTC 2004 batch, there was a provision of giving an honorarium of Rs 2500 per month to the trainees till they were appointed as assistant teachers. In the 2004 batch, hundreds of candidates who did B.Ed through distance education method also took admission. But the state government refused to recognize this degree for appointment to the post of assistant teacher in primary schools. Against this, on 26 October 2007, the High Court had considered them eligible for appointment on the petition of BEd trainees through distance method. The State Government’s SLP against this decision was dismissed by the Supreme Court on 26 April 2013, after which their six-month training started from September 2013.
RTE implemented amid legal battle
The training was completed in September 2014, but in the meantime, due to the implementation of the Right to Free and Compulsory Child Education (RTE) Act in Uttar Pradesh in July 2011, TET became mandatory for appointment to the post of assistant teacher, whereas the specific BTC 2004 training There was no compulsion of TET. The candidates who have completed the training and also passed the TET got government jobs, but about 500 trainees were left who could not clear the TET.
If the job is not found then the fight for allowance started
These candidates petitioned the High Court to pay an honorarium of Rs 2500 per month till the appointment as per the specific BTC 2004 mandate. On which the court ordered the state government to pay the allowance on 18 February 2020. On disobeying the orders of the government, these trainees filed a contempt petition, on which the court again ordered payment of honorarium on December 2, 2020.
2.75-2.75 lakh outstanding since 2013
The government’s SLP against the High Court order was dismissed by the Supreme Court on July 11, 2022. On this, the state government again filed a review petition, which was rejected on 31 January 2023. Candidates Vandana Singh of Kanpur, Srinath Pandey of Pratapgarh, Vijay Mishra of Jaunpur, Satpal Singh of Baghpat, Nisha Mishra of Prayagraj and Narendra Pratap Singh of Ballia say that from September 2013 to the present time, about 2.75-2.75 lakhs are due for 112 months. Honorarium is made.
