Why registrar didn’t issue marriage certificate even though couple got married in temple, HC slams authorities
Ahmedabad: The Gujarat High Court on Wednesday slammed the Patan district authorities on a petition filed by a couple. which complained that the registrar had rejected his application for registration of marriage stating that no such marriage had taken place. However, the discussion on this issue in the High Court was very interesting. And the judge also raised the issue of verification. It is worth mentioning that the couple got married in Mahadev’s temple. After that, it has also come to light that the couple is being troubled by the family members of the woman.

The couple’s advocate submitted before the court that the couple lived in the same residential colony. Both fell in love and then ran away from home. They got married in Dethli’s Vateswara Mahadev temple in January and then applied for registration of their marriage age.

A month later, on February 13, the registrar rejected his application. Because the temple management did not confirm that the couple got married there when they inquired with the authorities. They requested the High Court to direct the authorities to register their marriage and issue the certificate.

The judge struck on the verification issue
They also complained that the marriage was not registered due to the influence of the woman’s family members.
Justice Sangeeta questioned “Under which provision of law did they go for verification? The court wants to know when they started visiting and inspecting the place to verify whether the marriage was consummated. So every time like this, in every case of birth and death they will visit the place to verify whether birth or death has taken place?

The High Court granted police protection to the couple
The couple’s counsel also told the court that after the escape, the couple had approached the High Court seeking police protection from the woman’s family members. The High Court had ordered the Patan police to protect them last month. The court has sought a reply from the concerned officials by March 29.
